Training Agreement & Liability Waiver

Medical Consultation & Individual Results
I understand that Living Zoi strongly recommend that you consult with your physician before beginning any exercise program. You should be in good physical condition and be able to participate in the exercises. Living Zoi is not a licensed medical care provider and represent that they have no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of any specific exercise on a medical condition. Each individual's health, fitness, and nutrition success depends on his or her background, dedication, desire, and motivation. As with any health-related program or service, your results may vary, and will be based on many variables, including but not limited to, your individual capacity, life experience, unique health and genetic profile, starting point, expertise, and level of commitment.
Assumption of Risk
Using the Living Zoi', services, or activities involves the risk of injury to you or your guest, whether you or someone else causes it. Specific risks vary from one activity to another and the risks range from minor injuries to major injuries, such as catastrophic injuries including death. In consideration of your acceptance of the benefits under this agreement, you understand and voluntarily accept this risk and agree that Living Zoi', its officers, directors, employees, volunteers, agents and independent contractors will not be liable for any injury, including, without limitation, personal, bodily, or mental injury, economic loss or any damage to you, your spouse, guests, unborn child, or relatives resulting from the negligence of Living Zoi' or anyone on Living Zoi' behalf or anyone else whether related to exercise, nutrition or not.
Indemnification
You agree to indemnify, defend and hold Living Zoi' harmless against any liability, damages, defense costs, including attorneys' fees, or from any other costs incurred in connection with claims for bodily injury, wrongful death or property damage caused by your negligence or other wrongful acts or omissions. You further agree to hold harmless, defend and indemnify Living Zoi' from all liability, damages, defense costs, including attorneys' fees, or from any other costs incurred in connection with claims for bodily injury, wrongful death or property damage brought by you, your guests, or minors, even if Living Zoi' was negligent.
Release of Liability
You understand and acknowledge that Living Zoi' is providing recreational services and may not be held liable for defective products. In consideration of my participation in the Nutrition Coaching, I hereby accept all risk to my health and of my injury or death that may result from such participation and I hereby release Living Zoi its officers, directors, employees, volunteers, agents and independent contractors from any liability to me, my personal representatives, estate, heirs, next of kin, and assigns for any and all claims and causes of action for loss of or damage to my property and for any and all illness or injury to my person, including my death, that may result from or occur during my participation in the Nutrition Coaching, whether caused by negligence of Living Zoi its officers, directors, employees, volunteers, agents and independent contractors or otherwise. I further agree to indemnify and hold harmless Living Zoi its officers, directors, employees, volunteers, agents and independent contractors from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in the described Nutrition Coaching sessions.
